Vehicle Shipping Terms of Service

Introduction

Welcome to FreightSideKick.com, hereinafter also referred to as "FreightSideKick," a freight and vehicle shipping service and web platform for freight and vehicle shipping. By using our services, you agree to these Terms of Service.

Definitions

  • Customer: The individual or entity requesting vehicle transportation.
  • Carrier: The licensed motor carrier responsible for transporting the vehicle.
  • Broker: The company arranging the transportation of the vehicle.
  • Shipment: The vehicle being transported.
  • Bill of Lading: A document outlining the condition of the shipment at pickup and delivery.
  • Carrier Acceptance: The point at which a carrier has been selected and contracted to transport the vehicle. This may occur at varying times before the planned shipment date and is not necessarily predetermined.
  • Freight Shipping Terms and Conditions: The terms and conditions governing non-vehicle freight shipments, which are incorporated herein by reference and can be found here.

Services

  • We arrange for vehicle transportation through third-party carriers. We act as a broker and do not transport vehicles ourselves.
  • We provide estimated pickup and delivery windows, but actual times may vary based on carrier availability and external factors.
  • The customer will receive notification once a carrier has been assigned to their shipment.

Customer Responsibilities

  • Accuracy of Information: Ensure all details provided are correct, including pickup and delivery addresses, contact information, and vehicle details. Any changes may result in additional fees and delays.
  • Vehicle Preparation: Remove all personal items from the vehicle. Secure or remove any loose parts or accessories. Vehicles must have a quarter tank of fuel, be operable (unless specified as inoperable), and have functional brakes and steering.
  • Personal Belongings: One suitcase or bag containing personal items is allowed per vehicle, free of charge. Items must be stored in the trunk or below the window level and must not exceed 100 pounds. No hazardous materials, valuables, or illegal substances are allowed. Personal items that are damaged, lost, or stolen are not covered by our insurance and you ship them at your own risk.
  • Pickup and Delivery: Be present or appoint an agent at both pickup and delivery locations. Inspect the vehicle upon both pickup and delivery, and document any pre-existing damage on the Bill of Lading. Failure to inspect and document at both points may affect damage claims.
  • Notification of Changes: Inform us immediately of any changes to contact information or vehicle condition that may affect the transport.

Fees and Payment

  • Full payment is due upon carrier acceptance of the order. We may in some cases wait until the date of pickup to charge a credit or debit card that you provided at booking.
  • Additional fees may apply for changes in order details, including but not limited to changes in vehicle condition, pickup or delivery locations, or delays caused by the customer.
  • If the customer fails to make the vehicle available at the agreed pickup time, additional fees for a dry run and/or rescheduling may apply.

Cancellation and Refund Policy

  • Orders can be canceled without fees before carrier acceptance. Once the carrier has been assigned, cancellations will incur a fee of $250.
  • Refunds are issued only for services that have not been fulfilled. Once a vehicle is in transit, no refunds will be provided.
  • In the event of delays caused by the carrier, we will work with all the parties to coordinate and reschedule the shipment at no additional cost to the customer.

Loss, Damage, or Delay Claims

  • We are not liable for any loss or damage to the vehicle. All claims for loss or damage must be filed directly with the carrier. The carrier's liability is typically limited by federal regulations and the terms of the Bill of Lading.
  • Customers are advised to maintain their own insurance coverage for the vehicle during transport. The carrier’s insurance may not cover all types of damage or loss.

Arbitration

  • Any disputes arising from or related to these terms will be resolved through binding arbitration under the rules of the American Arbitration Association. Claims must be submitted individually and not as part of a class action.
  • Arbitration will take place in the state of Oregon, and the decision of the arbitrator will be final and binding.

Governing Law

  • These terms are governed by the laws of Oregon. Any legal actions arising from these terms will be resolved in the courts of Oregon.

Additional Provisions

  • Force Majeure: We are not liable for delays or failures in performance due to events beyond our control, including but not limited to extreme weather and natural disasters, acts of God, or governmental actions.
  • Entire Agreement: These terms constitute the entire agreement between the parties and supersede all prior agreements and understandings, whether written or oral.
